Damage And Liability Policy

Last updated: October 6, 2026

This policy describes customer responsibility for damage, loss, unsafe use, and incidents during a Tamarind motorbike rental.

Customer Responsibility

  • The customer may be responsible under the signed paper agreement and applicable law for damage, loss, theft, missing equipment, traffic fines, and third-party claims attributable to the rental or an unauthorized rider.
  • The customer must report accidents, theft, breakdowns, police interactions, or safety issues as soon as possible.
  • Unauthorized riders, illegal use, reckless use, or travel outside agreed limits may increase liability.

Inspection And Evidence

  • Staff may record pickup and return condition, photos, odometer readings, fuel level, and notes.
  • A customer should raise visible condition issues before leaving pickup.
  • Damage or loss assessment may use pickup and return records, photos, repair quotes, replacement costs, receipts, staff inspection, police records, third-party claim information, or other relevant evidence.
  • Damage and missing-equipment charges must be itemized and supported by a condition photo, published fee, repair invoice, or replacement cost. Normal wear is not chargeable, and punitive amounts or automatic lost-future-income amounts are not added.

Fuel Shortfall

  • Fuel is returned at the documented handover level. A shortfall uses the published fixed rate of THB 150 per missing mark on the gauge scale recorded at handover. Each bike uses its model’s configured marks or equivalent analogue steps; shortfalls across swaps are collected together at final return.
  • The recorded handover and return fuel levels are the charge authority. Photos are optional corroboration and are never required to charge or waive a shortfall. Staff do not enter a fuel amount.
  • If a bike’s handover reading or gauge scale is missing, only that bike period is unchargeable. Earlier documented shortfalls remain payable. Staff record the missing evidence and any return reading that can be recorded on the saved scale.
  • Staff may waive the outgoing bike’s shortfall at a swap with an audited reason. At final return, a reasoned waiver covers all remaining fuel shortfalls, including earlier bikes. If the final gauge cannot be read, staff use this whole-fuel waiver and record the reason; they never invent a reading.

Charges

  • Recorded damage, fuel, or equipment costs may be charged or withheld from the deposit where the signed agreement, evidence, and applicable law allow.
  • A deposit withholding requires a recorded reason. Any additional amount collected at return must also be recorded through the payment ledger; later corrections or refunds are separate records.
  • A verified traffic or parking fine that arrives later is handled from the official notice as a separate reimbursement, with no automatic card charge and no admin fee at launch.
  • This page does not promise insurance coverage or a fixed liability outcome. Coverage and responsibility depend on the incident, policy terms, signed agreement, evidence, and applicable law.
  • The retained rental snapshots preserve the bike and quote facts used for the rental contract.
